Amble Marina Limited Wireless Access Service

The public wireless network (Service) is provided by Amble Marina Limited (we or us). This acceptable use policy sets out the terms between you and us under which you may access our Service.

 

Your use of our Service means that you accept, and agree to abide by, this policy. Amble Marina Limited is registered as a limited company in England and Wales under registered number 926578. We have our registered office at Amble Marina, Amble, Northumberland, NE65 0YP.

1. Accessing our Service

1.1 Access to our Service is permitted on a temporary basis and we reserve the right to withdraw or amend our Service without notice (see below). We will not be liable if for any reason our Service is unavailable at any time or for any period.
1.2 If you choose, or you are provided with, a user identification code, password or any other piece of information as part of our security procedures, you must treat such information as confidential and you must not disclose it to any third party. We have the right to disable any user identification code or password, whether chosen by you or allocated by us, at any time, if in our opinion you have failed to comply with any of the provisions of these terms.
1.3 We do not guarantee that the Service will be compatible with any hardware or software you use.

2. Prohibited Uses

2.1 You may use our Service only for lawful purposes. You may not use our Service:
2.1.1 in any way that breaches any applicable local, national or international law or regulation;
2.1.2 in any way that is unlawful or fraudulent, or has any unlawful or fraudulent purpose or effect;
2.1.3 for the purpose of harming or attempting to harm minors in any way;
2.1.4 to send, knowingly receive, upload, download, use or re-use any material which:
2.1.4.1 is defamatory of any person;
2.1.4.2 is obscene, offensive, hateful or inflammatory;
2.1.4.3 promotes sexually explicit material;
2.1.4.4 promotes violence;
2.1.4.5 promotes discrimination based on race, sex, religion, nationality, disability, sexual orientation or age;
2.1.4.6 infringes any copyright, database right or trade mark of any other person;
2.1.4.7 is likely to deceive any person;
2.1.4.8 is made in breach of any legal duty owed to a third party, such as a contractual duty or a duty of confidence;
2.1.4.9 is threatening, abuse or invade another’s privacy, or cause annoyance, inconvenience or needless anxiety;
2.1.4.10 is likely to harass, upset, embarrass, alarm or annoy any other person;
2.1.4.11 is used to impersonate any person, or to misrepresent your identity or affiliation with any person;
2.1.4.12 gives the impression that it emanates from us, if this is not the case;
2.1.4.13 advocates, promotes or assists any unlawful act such as (by way of example only) copyright infringement or computer misuse.
2.1.5 to transmit, or procure the sending of, any unsolicited or unauthorised advertising or promotional material or any other form of similar solicitation (spam);
2.1.6 to knowingly transmit any data, send or upload any material that contains viruses, Trojan horses, worms, time-bombs, keystroke loggers, spyware, adware or any other harmful programs or similar computer code designed to adversely affect the operation of any computer software or hardware.
2.2 You also agree:
2.2.1 not to reproduce, duplicate, copy or re-sell any part of our Service;
2.2.2 not to access without authority, interfere with, damage or disrupt:
2.2.2.1 any part of our Service;
2.2.2.2 any equipment or network on which our Service is hosted, accessed or used;
2.2.2.3 any software used in the provision of our Service; or
2.2.2.4 any equipment or network or software owned or used by any third party.

3. Our Liability

Our Service is provided to you free of charge and as such, without any guarantees, conditions or warranties as to its availability, speed, operation, functionality, confidentiality or capabilities. To the extent permitted by law, we hereby expressly exclude:
3.1 all conditions, warranties and other terms which might otherwise be implied by statute, common law or the law of equity;
3.2 any liability for any direct, indirect or consequential loss or damage incurred by any user in connection with our Service or in connection with the use, inability to use, or results from the use of our Service, or results from the termination of your ability to use our Service by us, any website accessed via it and any materials posted via it including, without limitation any liability for:
3.2.1 loss of income or revenue;
3.2.2 loss of business;
3.2.3 loss of profits or contracts;
3.2.4 loss of anticipated savings;
3.2.5 loss of data;
3.2.6 loss of goodwill;
3.2.7 wasted management or office time; and
for any other loss or damage of any kind, however arising and whether caused by tort (including negligence), breach of contract or otherwise, even if foreseeable.

4. Information about you and your use of our Service

To the extent that you provide us with any information about you in the course of accessing and using the Service, we process such information in accordance with our privacy policy. By using our Service, you consent to such processing and you warrant that all data provided by you is accurate.

5. Suspension and Termination

5.1 We will determine, in our discretion, whether there has been a breach of these terms through your use of our Service.
5.2 Failure to comply with these terms may result in our taking all or any of the following actions or such action as we deem appropriate:
5.2.1 immediately, temporarily or permanently withdraw your right to use our Service;
5.2.2 immediately, temporarily or permanently remove any posting or material uploaded by you to our Service;
5.2.3 issue a warning to you;
5.2.4 bring legal proceedings against you for reimbursement of all costs on an indemnity basis (including, but not limited to, reasonable administrative and legal costs) resulting from the breach; and
5.2.5 disclose such information to law enforcement authorities as we feel is reasonably necessary.

6. Changes to these terms

We may revise these terms at any time by amending this page. You are expected to check this page to take notice of any changes we make, as they are legally binding on you. Some of the provisions contained in these terms may also be superseded by provisions or notices published elsewhere via our Service.

7. Jurisdiction and Applicable Law

The English courts will have exclusive jurisdiction over any claim arising from, or related to, our Service, although we retain the right to bring proceedings against you for breach of these terms in your country of residence or any other relevant country. These terms are governed by English law.

8. Trademarks

All trademarks and branding use by used in connection with the Service are owned by us and nothing in these terms nor the use of the Service by you shall give you any rights in or to the same.

9. Severance

If any provision of these terms is held to be unenforceable in whole or in part, it shall be severed from the remainder of these terms which shall remain in full force and effect.
